ikoala provides an interactive online service operated by IKOALA.COM.AU PTY LTD. (herein referred to as ikoala) on the Internet (the Web), consisting of information services, content and transaction capabilities provided by Ikoala, affiliates of Ikoala and other third Parties. Ikoala shall have the right at any time to change or discontinue any aspect or feature of Ikoala including, but not limited to, content, hours of availability and equipment needed for access or use.

Copyright and Trademarks

Everything located on or in this Site, is the exclusive property of IKOALA.COM.AU PTY LTD. or used with express permission of the copyright and/or trademark owner. Copyright, trademark or other intellectual property right infringement may result in civil and / or criminal penalties.

Termination

Ikoala may terminate this Agreement at any time. Without limiting the foregoing, Ikoala shall have the right to immediately terminate any passwords or accounts of end user in the event of any conduct by end user which ikoala, in its sole discretion, considers to be unacceptable, or in the event of any breach by End User of this Agreement.

Trademarks

Ikoala is a trademark of Ikoala Ltd. All rights in respect of this trademark are hereby expressly reserved. Unless otherwise indicated, all other trademarks appearing on Ikoala are the property of their respective owners.

Third Party Content

Ikoala is a distributor (and not a publisher) of content supplied by third parties. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties are those of the respective author(s) or distributors and not of Ikoala. Ikoala does not guarantee the accuracy, completeness, or usefulness of any content, nor its merchant-ability or fitness for any particular purpose. Ikoala contains links to third party Web sites maintained by other content providers. These links are provided solely as a convenience to you and not as an endorsement by Ikoala of the contents on such third-party sites and Ikoala hereby disclaims any representations regarding the content or accuracy of materials on such third-party Web sites.

Terms Of sale

By placing an Order, you make an offer to us to purchase the Vouchers you have selected on the terms and conditions stated below. You are required to create an account in order to purchase any product. This is required so we can provide you with easy access to print your orders, view your past purchases and modify your preferences.

Terms and Conditions for Restaurant-Specific Certificates

For this section, Restaurant shall be defined as a merchant who offers food and beverage for sale in its regular business operations, and is making such food and beverages available to purchasers of Ikoala vouchers.
Redemption dates and times are determined by restaurants, and shall be contained in the voucher offer on Ikoala.
It is at the discretion of the restaurant to determine whether Ikoala vouchers can be combined with any other restaurant offers, third party offers, or other promotions.

Restaurant-Specific Vouchers cannot be used for taxes, tips or prior balances, unless permitted by the Restaurant. Valid for dine in only unless otherwise stated.
The issuing of restaurant credit is at the sole discretion of the restaurant unless otherwise required by law.
Neither the seller nor the restaurant is responsible for lost or stolen vouchers.
Reproduction, sale or trade of Restaurant-Specific vouchers is prohibited unless done so in compliance with the law.
Any attempted redemption not consistent with these terms & conditions will render the Restaurant-Specific voucher void.
Void to the extent prohibited by law.
All vouchers expire on the date specified on the Ikoala voucher.

Terms and Conditions for Non-Restaurant Merchant Vouchers

Merchant vouchers may be applied only to merchandise sold by the merchant, and may not be applied to shipping or handling charges.
Limit one (1) voucher per redemption. Only one voucher can be used per order unless otherwise specified by merchant.
The issuing of credit is at the sole discretion of the merchant.
Neither the seller nor the merchant is responsible for lost or stolen vouchers.
Ikoala vouchers cannot be combined with any other gift certificates, third party vouchers, coupons, or promotions, unless otherwise specified by merchant
Reproduction, sale or trade of this voucher is prohibited unless done so in compliance with the law.
Any attempted redemption not consistent with these terms and conditions will render the voucher null and void.
Void to the extent prohibited by law.
All vouchers expire on the date specified on the Ikoala voucher.

Refund Policy

ikOala conforms to the Australian Consumer Law standards for refunds, repairs and replacements. Please carefully read the following terms and conditions relating to the return of an item as they form part of your agreement when purchasing goods and services through the ikOala website.

ikOala is a deals based website and as such acts as a promoter of deals from variety of different merchants. ikOala is happy to assist you in dealing with any purchase problems by liaising with the merchant on your behalf. ikOala is not responsible for, and accepts no liability for, the actions of merchants in dealing with any refund or replacement problems.

Please consider your purchase carefully. ikOala does not accept products and services for refund due to a change of mind.  

Holiday Vouchers

In the case of holiday vouchers where the purchase of the holiday is dependent on strict terms, if you do not meet the terms and conditions subsequent to your purchase then a refund will only be provided under the terms described in offer.

If you have taken the holiday and are dissatisfied with the accommodation, holiday or tour then you will need to contact the ikOala support desk on 1800 456252 or support@ikoala.com.au. ikOala will contact the merchant  who has provided the deal and escalate your concerns with them, however ikOala will not accept any liability for the accommodation, holiday or tour not meeting your expectations.

The issuing of credit or a refund is at the sole discretion of the merchant unless otherwise required by law.

Other Service Vouchers

In the case of service vouchers where the purchase of the service is dependent on strict terms, if you do not meet the terms and conditions subsequent to your purchase then a refund will only be provided under the terms described in offer.

If you have used the service and are dissatisfied with the quality of the service you will need to contact the ikOala support desk on 1800 456252 or support@ikoala.com.au. ikOala will contact the merchant  who has provided the deal and escalate your concerns with them, however ikOala will not accept any liability for the service not meeting your expectations.

The issuing of credit or a refund is at the sole discretion of the service provider unless otherwise required by law

Product Vouchers

 Return of Incorrect Items

If you purchase a product that you believe is:

  • Faulty at time of delivery(DOA) or has experienced an Early Life Failure* (ELF),

  •  Different to the size you have ordered

  • Substantially different in colour or style to what you have ordered, or

  • Has not been correctly advertised

*An Early Life Failure (ELF) occurs if an item has become faulty within 14 days of delivery of the item and is NOT a result of damage caused by the user.

 You will need to contact the ikOala support desk as soon as possible on 1800 456252 or support@ikoala.com.auand advise ikOala of the reason you wish to obtain a refund or replacement. ikOala may need to contact the merchant that has supplied the goods for additional information about the item, and you may be required to provide photographic or video proof of the problem. Please advise ikOala at that time whether you would like to have the item replaced, refunded or a credit provided.

Once ikOala is satisfied that your problem is valid then you will be provided details for returning the item and you will be issued with an RMA number (RMA stands for Return Merchandise Authorisation). When returning the item please include details of your name and the order identification number and RMA number to ensure that your return is processed quickly. Any item that ikOala receives without an RMA number will be returned to the sender.

In each of these cases ikOala will cover the postage cost of returning the item. ikOala does not accept responsibility for returned goods until they have been received by ikOala. It is therefore important that returned items are sent using a registered post service to ensure that returned items can have their location verified. If you choose not to use a registered post service when returning the goods then ikOala cannot accept responsibility for items that are lost in the mail.

Certain types of goods cannot be returned for a refund if they show evidence that they have been used and are not in original condition. For example, a tablet PC or Smartphone that has a scratched screen can only be repaired under the applicable warranty conditions.

All items must be returned in its original condition and with all accessories, contents and any free gifts with purchase included.

Returns for any other reason

If you are unhappy with your purchase for any other reason you will need to contact the ikOala support desk on 1800 456252 or support@ikoala.com.au and request to return the product. If ikOala agrees to your request to return the item then ikOala will issue you with an RMA number. It is your responsibility to return the item to ikOala in good condition as IkOala is not obliged to and will not cover the cost of returning items. If goods are sent to ikOala by COD or have ‘More to Pay’ stamped on them then ikOala reserves the right to reject these parcels and have them returned to the sender. Any item that ikOala received without an RMA number will be returned to the sender. Any item that ikOala agrees can be returned for change of mind or dissatisfaction will be for a store credit only when the product is received.

kOala does not accept responsibility for returned goods until they have been received by ikOala. It is therefore important that returned items are sent using a registered post service to ensure that returned items can have their location verified. If you choose not to use a registered post service when returning the goods then ikOala cannot accept responsibility for items that are lost in the mail.

All items must be returned in its original condition and with all accessories, contents and any free gifts with purchase included.

Warranty

All goods sold come with a warranty that is provided by the merchant. Unless otherwise stated, the warranty for all items sold will be 3 months. If a longer warranty is available for a particular item then this will be disclosed in the advertisement for that item. If you are still unsure of the warranty period that relates to a purchase, please contact support@ikoala.com.au and we will provide you with information about the warranty.  

GST (Goods and Services Tax)


ikOala will provide you with a tax invoice for your purchases specifying:

(i) that it is a tax invoice;

(ii) that ikOala is the issuer of the tax invoice;

(iii) ikOala’s ABN;

(iv) a description of the goods/services including the quantity (if applicable);  

(v) the price of the goods/services;

(vi) the date of issue of the tax invoice; and (vii) the amount of GST (if any) included in the price of the good/services.

GST will often not be included in the price, for example, where goods are being supplied by an overseas merchant.

Where goods are supplied by an overseas merchant, they will ordinarily be delivered by international mail without GST or customs duty being payable, that is, in cases where the value of the goods is less than $1,000. ikOala bears no responsibility for any GST or customs duty liability arising in relation to goods delivered from overseas merchants.

Additional Terms and Conditions for All Ikoala Products

All vouchers printed from the Ikoala website are promotional vouchers that are offered to customers below their face value and shall be subject to the terms and conditions of Ikoala and the participating Restaurant or merchant.
The holder and issuer of a Restaurant-Specific Voucher is the restaurant. The holder and issuer of a Merchant Voucher is the merchant. As a holder and issuer of the Voucher, the restaurant or merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the restaurant or the merchant.
The end user agrees to defend, indemnify and hold harmless ikoala, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys fees, arising out of the use of this site and/or any affiliated sites by the end user.
Restaurant-Specific Vouchers and Merchant Vouchers are redeemable in their entirety only and may not be redeemed incrementally.
